Administration of the EPBC Act
Introduced over 20 years ago, the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was designed as Australia’s primary national environmental legislation to provide an effective framework for the administration of referrals, assessments and approvals; whilst reducing impacts on the environment.
A recent independent performance audit was undertaken to assess the effectiveness of the administration of the EPBC Act.
Conducted by the Auditor-General, the Report No 47 2019-20 Referrals, Assessment and Approvals of Controlled Actions under the Environment Protection and Biodiversity Conservation Act 1999 identified a number of key factors relating to the administration of the EPBC Act.
Eight recommendations were also made by the Auditor-General for implementation.
In light of the findings and recommendations, we believe a harder line approach to compliance against EPBC Act conditions, including pre-commencement conditions for approvals of plans or other documents will be enforced.
